General Terms and Conditions (GTC) of Scapre Mind Project GmbH
1. scope and subject matter of the contract
These General Terms and Conditions (GTC) govern all contractual relationships between Scapre Mind Project GmbH (hereinafter referred to as “Scapre Mind Project”) and its customers in connection with the organization of events, outdoor escape games and other services offered by Scapre Mind Project.
By booking a service, participants accept these GTC as a binding part of the contractual relationship.
2. conclusion of contract
2.1 A contract is concluded as soon as Scapre Mind Project has confirmed a booking request from the customer in writing, by telephone or by e-mail.
2.2 Upon confirmation, all rights and obligations arising from the contract – including these GTC – come into force for both parties.
2.3 Verbal collateral agreements require written confirmation by Scapre Mind Project in order to be valid.
3. scope of services
3.1 The exact content of the service can be found in the respective event description, the offer or the booking documents.
3.2 Individual adaptations or special requests shall only become part of the contract if they have been expressly confirmed in writing by Scapre Mind Project.
3.3 Unless otherwise stated in the event description, the services begin with the arrival of the group at the agreed venue.
3.4 Participants are responsible for their own arrival and punctuality. If they arrive later than 15 minutes after the start time, they forfeit their entitlement to the booked service without the right to a refund.
4 Prices and terms of payment
4.1 The applicable prices can be found on the official website outofmind.ch. All prices are in Swiss francs (CHF) including VAT, unless otherwise stated.
4.2 A deposit may be required. This will be retained in part or in full in the event of last-minute cancelations.
4.3 Payment for online bookings is made by credit card or Twint. If “Payment on site” is selected, payment is made on the day of the event in cash or via Twint. One person is responsible for payment for the entire group.
4.4 For company or group events, an invoice or booking confirmation will be issued on request.
5 Cancellation and withdrawal conditions
Individual and small group bookings (up to 10 people)
5.1 Cancellation free of charge is possible up to 72 hours before the agreed date.
5.2 For cancellations between 72 and 24 hours before the start, 50% of the total amount will be charged.
5.3 For cancellations within 24 hours or no-shows, the full amount will be charged.
Group bookings (from 11 persons)
5.4 For groups of 11 or more participants, the following applies: Cancellation free of charge up to 7 days before the event.
5.5 Scapre Mind Project reserves the right to charge 50% of the booking amount for cancellations within 6 days of the event.
General provisions
5.6 Cancellations must be submitted in writing (e-mail) or by telephone, stating the booking details.
5.7 Cancellations will be processed during business hours; the cancellation will only be deemed effective upon written confirmation by Scapre Mind Project.
5.8 In justified cases such as illness or unforeseen events, an accommodating decision will be made on a case-by-case basis.
6. conditions of participation
6.1 Children under the age of 12 may only participate in events if accompanied by an adult.
6.2 Participants undertake to follow the instructions of the staff and to behave in a respectful and safety-conscious manner.
6.3 Scapre Mind Project reserves the right to exclude persons who are under the influence of alcohol or drugs or whose behavior endangers the event from participation. There will be no refund in such cases.
7 Liability of the participants
7.1 Participants are fully liable for damage to Scapre Mind Project material, equipment or facilities caused intentionally or through gross negligence.
7.2 Scapre Mind Project may demand compensation for damage caused by improper use or disregard of safety instructions.
8. changes or cancellations by participants
8.1 The contract refers to the booked date, time slot and the specified number of participants.
8.2 There is no entitlement to a refund in the event of no-shows or last-minute cancellations. However, Scapre Mind Project will endeavor to find a fair solution in individual cases.
9. changes or cancellations by Scapre Mind Project
9.1 Scapre Mind Project may make changes to the course or content of the event for organizational or safety reasons.
9.2 If an event has to be canceled, customers will be informed immediately and will receive either an equivalent replacement offer or a refund of the amount already paid.
9.3 Further claims for compensation (e.g. for travel or accommodation costs) are excluded.
10. force majeure
10.1 Events such as natural disasters, war, political unrest, pandemics, official orders or other unforeseeable events are considered force majeure.
10.2 If an event has to be canceled due to such circumstances, there is no entitlement to compensation. However, Scapre Mind Project will endeavor to find an appropriate alternative solution.
11. exclusion of liability
11.1 Participation in the events is at the participant’s own risk. Insurance is the responsibility of the participants.
11.2 Scapre Mind Project is only liable for damages caused by intentional or grossly negligent behavior on the part of the company.
11.3 Liability for indirect damages, loss of enjoyment, third-party services or consequential damages is expressly excluded.
11.4 Scapre Mind Project assumes no responsibility for the accuracy, timeliness or completeness of the content published on the Website.
11.5 No responsibility is assumed for external links; their use is at the user’s own risk.
11.6 All copyrights to content, images, logos or documents remain with Scapre Mind Project or the respective rights holders. Any further use requires written consent.
12. data protection
The processing of personal data is governed by the applicable data protection regulations, which can be viewed on the Scapre Mind Project website.
13. changes to the GTC
Scapre Mind Project may amend these GTC at any time. The current version published on the website is always authoritative.
14 Applicable law and place of jurisdiction
Swiss law applies exclusively to all contractual relationships.
The place of jurisdiction is the registered office of Scapre Mind Project GmbH in Brig (VS).
