General Terms and Conditions (GTC) of Out of Mind Escape Games
1. Subject Matter of the Contract
The General Terms and Conditions (GTC) regulate the legal relationships between you as the customer and Sarah Tanja Scarnato Out of Mind Escape Games (hereinafter referred to as Out of Mind Escape Games) in relation to events or other services offered by Out of Mind Escape Games.
2. Conclusion of the Contract
2.1 The contract between you and Out of Mind Escape Games is concluded upon acceptance of your written or telephone confirmation. From this point on, the rights and obligations arising from the contract (including these General Terms and Conditions) become effective for you and Out of Mind Escape Games.
3. Services
3.1 Our services are as described in the catalog and in the event documents. Special requests from participants or additions are only part of the contract if they have been confirmed in writing by Out of Mind Escape Games.
3.2 The services of Out of Mind Escape Games begin, unless otherwise noted in the event description, upon the arrival of the participants at the venue. Each participant is responsible for their own timely arrival. In case of a delay (from 15 minutes), the entitlement to the paid service lapses. There is no entitlement to a replacement service.
4. Prices
4.1 The prices for the events are available online on our website. The prices are for the entire group in Swiss Francs. The prices valid at the time of booking are applicable. The prices include VAT unless otherwise noted.
4.2 A deposit may be required, which may be retained in case of short-term cancellation. The amount can be paid online at the time of booking by credit card and Twint. For the option to pay on-site, we accept payment on the event day in cash or by Twint. One person pays the amount for the entire group.
4.3 For larger events (team events, team-building events), a booking confirmation with an invoice will be sent upon request.
5. Cancellation Policy
5.1 Cancellations of bookings for up to 10 people are free of charge up to 72 hours before the agreed date.
5.2 For cancellations between 72 and 24 hours before the agreed date, Out of Mind Escape Games reserves the right to charge a fee of 50% of the booking amount.
5.3 Cancellations within 24 hours before the agreed date or no-shows at the agreed time will result in the full booking amount being charged.
5.4 Special cancellation conditions apply for group bookings with more than 10 participants.
5.5 Cancellations of group bookings are free of charge up to 7 days before the agreed date.
5.6 For cancellations within 6 days before the agreed date, Out of Mind Escape Games reserves the right to charge a fee of 50% of the booking amount.
5.7 Cancellations due to unforeseen events such as illness or unavoidable circumstances will be reviewed on a case-by-case basis. Please contact us immediately in such cases to find a solution.
5.8 Cancellations must be made in writing by email or by phone, including the booking details.
5.9 Cancellation requests are processed during our business hours. Please note possible processing times and ensure that your request is submitted in a timely manner before the agreed date. Cancellations are only effective after confirmation by Out of Mind Escape Games.
6. Participation Conditions
6.1 Children under 12 years of age must be accompanied by at least one adult during our events. This regulation is part of our safety measures and ensures an enjoyable and safe experience for all participants. We ask all customers to observe this condition and ensure that younger participants are adequately supervised.
7. Terms of Use
7.1 Participants are fully liable for any damage to equipment and items caused willfully.
8. Changes to Registration or Cancellation of Participation Registration or cancellation of participation
8.1 The contract specifically refers to the booked time slot and the number of participating persons.
8.2 In case of cancellation by the participant or no-show at the agreed time, there is no entitlement to a refund. Out of Mind Escape Games will make every effort to find an amicable solution in such cases.
9. Program Changes by Out of Mind Escape Games, Cancellation of the Event
9.1 Out of Mind Escape Games reserves the right to make minor changes to the services. This does not affect the validity or content of the present contract.
9.2 It may occur that Out of Mind Escape Games must cancel an event or a booking. In this case, the participant will be informed immediately and offered an equivalent alternative. If the participant cannot accept this, they are entitled to a refund of the paid price. Claims for further compensation for expenses or losses are excluded.
9.3 Participation in the events of Out of Mind Escape Games may be refused to participants (group or individual group members) without further explanation if they are under the influence of alcohol and/or drugs, if there is an impression that the participants will use violence, willfully destroy the equipment, or behave otherwise unacceptably. There is no entitlement to a refund in this case.
10. Force Majeure
10.1 If the event has to be canceled due to force majeure, there is no entitlement to compensation. Force majeure are events that Out of Mind Escape Games could neither foresee nor avert. These include, but are not limited to: war, civil war, terrorism, political unrest, natural disasters, nuclear events, fire/water damage, or equivalent events.
11. Liability of Out of Mind Escape Games
11.1 Insurance is the responsibility of the participants.
11.2 Out of Mind Escape Games ensures that the agreed services are provided with reasonable care and appropriate knowledge. Out of Mind Escape Games is liable if the contractual agreements are not or insufficiently fulfilled due to omissions by Out of Mind Escape Games, its employees, or suppliers. Note that it is the responsibility of the participant to prove that reasonable care and knowledge were not provided. Liability towards employees and suppliers of Out of Mind Escape Games exists only if they were in a valid contractual relationship with Out of Mind Escape Games at the time of service.
11.3 Out of Mind Escape Games is not liable for direct or indirect damages such as injuries of any kind, death, losses (e.g., unexperienced enjoyment), or similar. Likewise, Out of Mind Escape Games assumes no liability for services to third parties.
11.4 Website Liability Disclaimer: Out of Mind Escape Games makes no warranties regarding the content accuracy, precision, timeliness, reliability, and completeness of the information on the website.
11.5 Liability for Links: References and links to third-party websites are outside the responsibility of Out of Mind Escape Games. Any responsibility for such websites is rejected. Access and use of such websites are at the user's own risk.
11.6 Copyrights: The copyright and all other rights to content, images, photos, or other files on the website belong exclusively to Out of Mind Escape Games or the specifically named rights holders. The written consent of the copyright holder must be obtained in advance for the reproduction of any elements.

13. Changes to the GTC
Changes to the GTC of Out of Mind Escape Games may be made at any time. The legally binding version is published on the website.
14. Applicable Law and Jurisdiction
14.1 The exclusive jurisdiction for all disputes is the location of Out of Mind Escape Games. Swiss law exclusively applies.
By booking and participating in our outdoor escape games, the customer accepts these General Terms and Conditions.
